Terms of Use

These Terms of Use (“Terms”) govern your use of cleardatasource.com (the “Site”) and any data files you download or purchase from Freedom Legacy LLC, doing business as ClearDataSource (“ClearDataSource,” “we,” “us”). By using the Site, downloading a sample, or completing a purchase, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it.

1. What you receive

Our products are data files compiled from public government records, such as California Contractors State License Board (CSLB) records, which we filter, organize, and format. Each file covers the source window described on the product page.

2. License to use the data

When you purchase a file, we grant you a non-exclusive, non-transferable license to use it for your organization’s own internal business development, prospecting, and market research. You may load it into your own CRM and share it with your own employees and contractors who work on your behalf.

You may not:

• Resell, sublicense, publish, give away, or otherwise distribute the file or any substantial part of it.
• Use the file to build or supplement a competing data product.
• Use the file for any unlawful purpose, including harassment, discrimination, or fraud.
• Use the file as a factor in deciding anyone’s eligibility for credit, insurance underwriting, employment, housing, or any other purpose covered by the Fair Credit Reporting Act. Our products are not consumer reports, and ClearDataSource is not a consumer reporting agency.

3. Your responsibility for outreach

You alone are responsible for how you contact anyone in our files. You agree to follow all laws that apply to your outreach, including the Telephone Consumer Protection Act (TCPA), the National Do Not Call Registry and state do-not-call rules, the CAN-SPAM Act, and California privacy and marketing laws. We do not scrub records against do-not-call lists unless a product page states otherwise. Please verify records before contacting anyone.

4. Data accuracy

Public records can contain errors, and business information changes over time. Our files are provided based on the source records available when the file was built. We do not guarantee that any record is accurate, complete, or current, or that you will achieve any particular sales result.

5. Payments and refunds

Prices are shown on the Site and are payable in U.S. dollars through Stripe. Because data files are delivered digitally and immediately, all sales are final. If you were charged more than once, or your file will not open or is materially different from the product description, email hello@cleardatasource.com within 7 days of purchase and we will make it right with a replacement file or a refund.

6. Free samples

Free sample files are provided so you can evaluate data quality and are subject to these same Terms.

7. Disclaimer of warranties

THE SITE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR OUR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend and hold harmless ClearDataSource and its owners from any claims, fines, or costs arising from your use of our data, including your outreach to anyone listed in it or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Orange County, California.

11. Changes

We may update these Terms from time to time. The version posted on this page at the time of your purchase applies to that purchase.
